The alleged accused Dawn Michelle KELLY (being the legal name used in commerce to gain financial advantage over the woman Dawn-Michelle in fraud) was acquitted of all charges brought forward by Jeffery Osborne in Al 2104 – 2106 and AL 2112. after a two and a half year ordeal.
The ordeal began in the Albany Magistrates Court where Magistrate Scaddan did not accept a medical certificate and convicted the alleged accused Dawn Michelle KELLY under section 55 of Criminal Procedures Act 2004 (WA) – non-appearance. When it was our intention to address the charges brought forward by Jeffery Osborne.
The matter finally concluded in the Perth Magistrates Court with a reserved decision made by Magistrate Randazzo acquitting the allged accused Dawn michelle KELLY of all charges.
The prosecution could not prove beyond reasonable doubt the identity of the alleged accused nor the identity of the Car. Evidence linking the alleged accused was circumstantial and the identity witnesses were not present on the day of the alleged offence.
If the police cannot identify beyond reasonalbe doubt an accused for prosecution there is no prosecution or charges to answer.
