According to the WESTERN AUSTRALIA POLICE website, now located on the Govco website, they say that the general public have rights!

They are now concealing the fact that they consider the general public to be customers – could that be because we live in a POLICE STATE!

It was determined by Magistrate Woods and supported by Justice Whitby in
KELLY -v- WA POLICE [2024] WASC 372 that police have unfettered powers and did not have to comply with Statutes (namely the Road Traffic (Administration) Act 2008 simply because they were police officers.

S.38 The magistrate was correct in finding that s 39 of the RTAA directly conferred a power on Sergeant Neeter, as a police officer, to direct the appellant to stop the Suzuki for the purposes of investigating an offence under a road law. Sergeant Neeter did not require a written delegation under s 8 and s 9 of the RTAA to issue a direction to the appellant to stop the Suzuki.

Community rights

According to WAPOL they say “When dealing with the Western Australia Police Force, members of the community have a right to:

  • Be treated honestly and openly.
  • Be treated fairly and with respect.
  • Request that police officers identify themselves.
  • Communicate or attempt to communicate with a friend, relative or legal practitioner if they are detained in custody.
  • Be cautioned prior to being formally questioned as an offender.
  • Be fully informed of all charges preferred.
  • Only be detained for as long as is lawfully necessary.
  • Have their safety and welfare needs met where detained, including the right to necessary medical attention.
  • Have their concerns acknowledged and responded to in a professional manner.”

Community obligations

The WA Police Force relies upon the cooperation of all members of the community to make Western Australia a safe and secure place. 

To play their part, citizens have a moral obligation to:

  • Comply with the law. What law are they referring to???
  • Assist and support their police and report information relating to any offence.
  • Treat members of the WA Police Force with respect and in a civil manner comply with any reasonable directions given by a police officer in the performance of his or her duty.

Let’s Get Retarded

On Monday 25th November 2024, Anthony Nutall [PD13324] admitted to disrespecting the ‘alleged accused’ on the first day of a three day trial during a lunch break in the corridor outside of the court room.

He admitted to calling the ‘alleged accused’ a RETARD or in his words in the witness box “Are you a retard?” which amounts to the same thing.

He was a key witness for the prosecutions case to establish identity. He was not a physical witness on the day in question. His evidence was based on a four second video and when other police officers say that ‘it could be’ or ‘looks like’, he was adamant that the driver was Dawn Michelle KELLY.
