Terrorism offence means —
2 (a) an offence against the Commonwealth Criminal 3 Code Division 72 Subdivision A
Subdivision A—International terrorist activities using explosive or lethal devices
(b) an offence against the Commonwealth Criminal 5 Code Division 80 Subdivision B; Treason 80.1 Treason (1) A person commits an offence if the person: (a) causes the death of the Sovereign, the heir apparent of the Sovereign, the consort of the Sovereign, the Governor‑General or the Prime Minister; or (b) causes harm to the Sovereign, the Governor‑General or the Prime Minister resulting in the death of the Sovereign, the Governor‑General or the Prime Minister; or (c) causes harm to the Sovereign, the Governor‑General or the Prime Minister, or imprisons or restrains the Sovereign, the Governor‑General or the Prime Minister; or (d) levies war, or does any act preparatory to levying war, against the Commonwealth; (g) instigates a person who is not an Australian citizen to make an armed invasion of the Commonwealth or a Territory of the Commonwealth. Penalty: Imprisonment for life.
(c) an offence against the Commonwealth Criminal 7 Code Part 5.3, [Part 5.3—Terrorism] other than an offence against 8 section 104.22, 104.27, 104.27A, 105.41 or 9 105.45
(d) an offence against the Commonwealth Criminal 11 Code Part 5.5
5.5 Negligence ; or
(e) an offence against the following provisions of 13 the Charter of the United Nations Act 1945 14 (Commonwealth) — 15 (i) Part 4; Part 4—Security Council decisions that relate to terrorism and dealings with assets. 16 (ii) Part 5, to the extent that it relates to the 17 Charter of the United Nations 18 (Sanctions—Al-Qaida) Part 5—Offences relating to UN sanctions 19 Regulations 2008 (Commonwealth); 19 Effect of resolution ceasing to bind Australia
(f) an offence against the Crimes (Foreign 22 Incursions and Recruitment) Act 1978 23 (Commonwealth) (repealed) An Act relating to Incursions into Foreign States and Recruitment for Service in Armed Forces in Foreign States; or
(g) an offence against the Crimes (Internationally 25 Protected Persons) Act 1976 (Commonwealth) 26 section 8 relating to offenses; or t
Terrorist act has the meaning given in the Terrorism 5 (Commonwealth Powers) Act 2002 section 3 terrorist act has the same meaning it has in the text set out in Schedule 1.
